Summary

This summary is not the full terms. Read the terms below.

1. Who these terms are for

1.1 These terms apply when you record a video, write a review or answer an interview (a "testimonial") through Proven Praise. Proven Praise ("we", "us") runs this service.

1.2 You make your testimonial for a business that you paid (the "business"). The business uses Proven Praise to ask for and show testimonials. The business is not part of Proven Praise.

1.3 You accept these terms when you send a testimonial. If you do not accept them, do not send it. You do not need an account.

2. Age

2.1 You must be 18 or older to send a testimonial.

2.2 If you are 16 or 17, you can send a testimonial only with the permission of a parent or guardian. Your parent or guardian accepts these terms for you.

2.3 If you are under 16, do not send a testimonial. If we find out that a person under 16 sent a testimonial, we delete it. A parent or guardian can ask us to delete it at hello@provenpraise.com.

3. Your testimonial

3.1 You keep the ownership of your testimonial. These terms give a license to use it. They do not transfer it.

3.2 A video can be up to 3 minutes long. You can watch it and record again before you send it. The business checks each testimonial before it goes public. The business can choose not to show it.

3.3 Your testimonial can show your face, your voice, your name, the title that you give and your rating. Do not include information that you do not want to make public, for example your address, your health or other people.

4. Where the business can use it

4.1 Before you send, you choose where the business can use your testimonial:

4.2 The business must use your testimonial only in the places that you chose. We store your choices with the date and time.

5. The license that you give

5.1 You give the business a worldwide, non-exclusive, royalty-free license to copy, show, share and publish your testimonial, your name, your title, your rating, your image, your likeness and your voice, only in the places that you chose in section 4, to promote the business and its products and services.

5.2 The business can trim your video, change its size or format, add captions of your exact words, and add its logo. The business cannot change the meaning of what you said, put your words in a different order, add words, or use AI to make a new voice, face or statement.

5.3 The license continues until you remove your testimonial. Section 11 tells you what removal cannot recall. The business can let its agencies and service providers use the testimonial for it. It cannot sell or give the license to another business.

5.4 You give us a worldwide, non-exclusive, royalty-free license to host, copy, transcode, transcribe, process, render and show your testimonial, only to give the service to the business and to you, and to keep the service secure.

5.5 We do not use your testimonial in our own marketing without separate permission from you and the business.

6. How AI processes your testimonial

6.1 When you send a video, these things happen: Mux stores and encodes the video. AssemblyAI makes a transcript of your words with the time of each word. Claude, an AI model from Anthropic, reads the transcript and selects 1 to 3 short clips and one quote. A render service adds captions to the clips and makes a quote card.

6.2 The AI only selects and cuts. Every caption and every quote is an exact part of what you said or wrote. The AI never changes your words. It never makes or changes your voice or your face.

6.3 Claude gets the text of the transcript, not your video. Proven Praise does not create face or voice templates. It does not use your face or voice to identify you.

6.4 The transcript can have errors. The business checks it before the testimonial goes public. If a caption or a quote is wrong, tell the business or tell us.

6.5 We do not use your testimonial or your transcript to train AI models.

7. AI case-study interviews

7.1 Some businesses can invite you to an interview. You answer questions by typing or by speaking. If you speak, AssemblyAI makes a transcript of your audio. The AI can ask one follow-up question.

7.2 The AI then drafts a case study about your experience. Every sentence that the case study shows as your words is an exact quote from your answers. The other text is the business's description, not your words.

7.3 Sections 4, 5, 10 and 11 also apply to your interview answers and to the case study.

8. The verification record

8.1 Proven Praise checks that you really paid the business. It signs a record that links your testimonial to the payment.

8.2 A public verification page shows the record: the business name, the payment date and an amount range (for example $100-500). It never shows your email, your card, the exact amount or the Stripe charge ID.

8.3 Anyone with the link can see the verification page while your testimonial is live. When you remove your testimonial, we delete the record.

9. Gifts and payment

9.1 You do not get payment for your testimonial, unless the business tells you about a gift or other incentive before you start.

9.2 If the business offers a gift, the business gives it to you, not Proven Praise. The gift must not depend on a positive opinion or on a public review. Proven Praise shows a disclosure of the gift next to your testimonial.

9.3 If you have another connection with the business, for example you work for it or are related to its owner, tell the business before you send. Do not send a testimonial as a customer in that case unless the connection is disclosed.

10. How to remove your testimonial

10.1 You can remove your testimonial at any time, for any reason. Open the verification page and select "Remove my testimonial". Enter the email that you paid with. We send a confirm link to that email. The link works for 24 hours.

10.2 When you confirm, we at once: remove the testimonial from all Proven Praise widgets, walls and hosted pages; delete the video, the clips, the quote card, the transcript, the text, your name, your title and your rating; and delete the verification record.

10.3 We keep a short record that the testimonial was withdrawn, so that it cannot go public again. Copies in our providers' backups and caches can stay for a short time until they expire.

10.4 If you cannot use the link, for example because you no longer have the email, send an email to hello@provenpraise.com. We check that the testimonial is yours, then we remove it.

10.5 After removal, the business must stop all new use at once. It must remove the testimonial from the places that it controls, including downloaded copies, within 7 days.

11. What removal cannot recall

Removal stops future use. It cannot undo what already happened. For example, removal cannot recall:

12. The business is responsible for its use

12.1 The business decides whether to show your testimonial, where to show it within your choices, and how to promote it. The business is responsible for that use and for its own marketing.

12.2 Proven Praise gives the tools. We do not control how the business uses a testimonial outside Proven Praise. If the business uses your testimonial in a way that these terms do not allow, tell us. We can act against the business account.

12.3 For your personal data in the testimonial, the business is the controller and Proven Praise is its processor. You can contact the business or us about your data.

13. Your promises

13.1 You promise that:

14. Privacy

14.1 Our privacy policy tells you what data we collect, how long we keep it and what rights you have.

14.2 You get one request email and a maximum of one reminder. You can unsubscribe with the link in each email.

15. Liability

15.1 We give the service free of charge to you. To the extent that the law allows, we are not liable to you for indirect loss, or for how the business or other people use your testimonial.

15.2 Nothing in these terms removes rights that the law gives you and that a contract cannot exclude, for example under the Australian Consumer Law or the privacy laws of your country.

16. Changes and governing law

16.1 We can change these terms. A change does not reduce the rights that you have for a testimonial that you already sent, unless you agree. The date and the version at the top show the current terms.

16.2 The laws of South Australia, Australia govern these terms. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you can bring a claim in the courts there.
